Centre releases draft amendments to regulate online gaming

NEW DELHI: The Information Technology Act, 2000 will be amended to impose strict controls due to the increase in number of fraud cases related to online games. The aim is to prevent betting and ensure the safety of users.

A draft rule of this was published for public comments. Comments can be posted on the website https://innovateindia.mygov.in/onlinegaming-rules by January 17.

Indian laws must be followed while using, uploading, publishing or sharing online games. The draft says that the intermediary platform should be cautious in this regard. The intermediary company should be registered under the IT Ministry. Registration information must be displayed in all online games. Games must comply with the laws of the country.

KYC should be followed

1. Users must be informed of the policies regarding the withdrawal or refund of deposit for the game, manner of determination and distribution of winnings and fees.

2. KYC procedures should be followed for user account registration. Users should verify their information

3. Information that you are a verified user must be displayed on the user account for others to see.

4. Foreign companies should provide Grievance Redressal Officer in India and Indian address is required. They are also directed to cooperate with the investigation.

Self-regulatory body

Companies that offer online games should form a self-regulatory body. The committee should have one member nominated by the central government (with a background in public policy, law enforcement or public finance) and another member with experience in psychology or medicine. Gaming companies need government approval to register the body.

“This amendment aims to make online games safer and more reliable. Intermediaries will be regulated. Women's safety will also be ensured.”, said Rajeev Chandrasekhar, Union Minister of State for IT.
