13-yr-old girl gets pregnant from 14-yr-old brother, HC grants permission for abortion

KOCHI: The High Court has given permission for abortion of a 13-year-old girl who is allegedly pregnant from her brother. The 13-year-old girl is 26 weeks pregnant. The order was issued on a petition filed by the father seeking permission to abort his daughter's pregnancy.

Despite a holiday on Monday, Justice Bechan Kurian Thomas held a special sitting to consider the petition. The court allowed the abortion to take place within 24 hours.

The girl was not able to appear before the board as she was in hospital though it was earlier directed to form a medical board to consider the case. As per the court order, the medical board examined the child and issued a report last day. It was reported that abortion could be performed despite the risks. Legally, a developing embryo of up to 20 weeks can be destroyed. Although the law was amended to make it up to 24 weeks, the court heard the case after 26 weeks of embryonic development.

“It may even have the possibility of reminding the victim of the incident of rape. It is obviously not in the interest of the society to have this young victim to undergo the trauma of the incident of rape everyday in her life. The anguish that the pregnancy causes to her will be lifelong and she may have to live with the traumatic experience throughout her life. The parents and the siblings will also have to share this trauma throughout their lives,” the judgment said. The order also calls for evidence to be collected for DNA testing of the fetus.
